Sub: Partial award on jurisdiction – SIAC arbitration n ° 960 of 2020
Following our previous information, we would like to inform that the lawyers of the Company have received a partial sentence dated 20e October 2021 from the Singapore International Arbitration Center in SIAC Arbitration No. 960 of 2020 on the company’s jurisdictional objection request.
The arbitral tribunal rendered a partial award rejecting the request for a jurisdictional exception and among others decided the following:
The Tribunal made only two final and conclusive findings concerning the three Agreements: (i) each of the Parties is bound by the FCPL SHA Arbitration Agreement, including FRL notwithstanding its non-signatory status, and (ii) FCPL SHA Arbitration The agreement extends to disputes under the FRL SHA and SSA.
Although the Tribunal made no final and binding conclusions on the effectiveness of the substantive provisions contained in the three agreements, the Company would decide its future course of action on the basis of legal advice and remedies available at law.
